Terms and Conditions

1. Scope

These terms apply to the purchase of the JUKISWAP software through the online shop at jukiswap.ch. The provider is Manuel Mohorovic Photography, Raiweg 4, 8108 Dällikon, Switzerland (hereinafter the "Provider").

This offer is currently addressed exclusively to customers residing in Switzerland and the Principality of Liechtenstein. Orders from other countries cannot be accepted; an extension to further countries will be announced on this website.

2. Subject of the contract

The subject of the contract is a simple, non-exclusive and perpetual right to use the software for your own purposes. The software is provided as a web application and runs in the browser of your device. No physical media is supplied.

3. Conclusion of the contract

The presentation in the shop is an invitation to order. By submitting your order you make a binding offer. The contract is concluded when the licence key and the access link are delivered to you.

4. Prices and payment

The price shown at the time of ordering applies, in Swiss francs. Payment is processed through Shopify Payments or the payment method chosen during checkout. All prices include Swiss VAT of 8.1%, which is itemised on the invoice.

5. Delivery

Delivery takes place immediately after receipt of payment, by e-mail to the address provided, and consists of an access link and a personal licence key. No physical goods are shipped.

6. Right of withdrawal for digital content

The separate withdrawal policy applies.

7. Rights of use

Access is intended for personal use and may be used on your own devices. Passing on the access link or licence key to third parties, reselling, copying or making the software publicly available is not permitted.

8. Availability and data backup

The software stores all content locally on your device. The Provider keeps no backup copies and cannot restore lost data. The software offers a backup function; regular backups are the responsibility of the user.

The only exception is the "Show binder" feature: if the list of cards offered for trade is too large for a QR code, it is kept available for the chosen period of at most 24 hours in a store on the Provider's hosting and deleted afterwards. Details are set out in the privacy policy.

Some features access third-party data sources. Their continued availability, completeness and accuracy are beyond the Provider's control. Displayed card prices are indicative and not a guarantee of market value.

9. Warranty and liability

The Provider is liable for damage caused by intent or gross negligence and for injury to life, body or health in accordance with the statutory provisions. Otherwise, liability is excluded to the extent permitted by law – in particular for lost profit, loss of data and consequential damage.

10. Changes to the software

The software is continuously developed. The Provider may add or adapt features as long as the contractual benefit is preserved.

11. Applicable law and jurisdiction

Swiss law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is the Provider's registered office, unless mandatory consumer-protection provisions provide otherwise.

JUKISWAP is not affiliated with Nintendo, The Pokémon Company, Creatures Inc. or GAME FREAK. All trademarks mentioned belong to their respective owners.
